1. Acceptance of Terms

Welcome to Neon Destiny Network. These Terms of Service ("Terms") govern your access to and use of the website, customer portal, game server hosting, website hosting, Discord bot hosting, and any related services (collectively, the "Services") provided by Neon Destiny Network ("us", "we", or "our"), operating within the Commonwealth of Pennsylvania.

By registering for an account, purchasing a service, or accessing our network, you agree to be bound by these Terms and our Acceptable Use Policy. If you do not agree to these Terms, you must immediately cease all use of our Services.

2. Eligibility & Account Security

To use our Services, you must be at least thirteen (13) years of age. If you are under 18, you represent that you have received parental or legal guardian consent to agree to these Terms. You agree to provide accurate, current, and complete registration information and to maintain the security of your account credentials. You are solely responsible for all activities, data usage, and purchases made under your account.

3. Billing, Fees, and Subscription Cancellation

• Billing Cycle: Services are billed in advance on a recurring monthly, quarterly, or annual basis depending on your selected billing plan.
• Late Payments: If payment is not received within three (3) days of the invoice due date, your services will be automatically suspended. Suspended services are subject to termination and data deletion after seven (7) days of non-payment.
• Cancellations: You may cancel your subscription at any time through the customer portal. Cancellation stops future renewals, but active service continues until the end of the current billing cycle. No partial refunds are provided for unused time.

4. Acceptable Use Policy (AUP)

You agree to use our network and hardware responsibly. The following activities are strictly prohibited and will result in immediate service suspension or termination without refund:

• Hosting or distributing malware, viruses, trojans, or pirated content (including DMCA-protected material without authorization).
• Performing unauthorized network scans, port scanning, or launching DDoS/DoS attacks against other networks.
• Running crypto-currency mining scripts, CPU stress tests, torrent clients, or any process that causes resource starvation on shared hosting environments.
• Using web or game servers to host botnets, spam relays, or engaging in any form of cyber-harassment.

5. Backups and Data Integrity

While we may maintain automated server backups for disaster recovery purposes, Neon Destiny Network does not guarantee the availability or integrity of these backups. It is your sole responsibility to perform regular backups of your website files, databases, game configurations, and user data. We are not liable for any data loss, corruption, or hardware failure.

6. Uptime and Service Level Agreement (SLA)

We strive to maintain a 99.9% network and node uptime. Scheduled maintenance windows will be announced in advance via Discord or Email. Neon Destiny Network is not liable for service outages caused by third-party upstream providers, global routing issues, local ISPs, or force majeure events (e.g., natural disasters, grid failure).

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEON DESTINY NETWORK AND ITS AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE FEES PAID BY YOU IN THE ONE (1) MONTH PRECEDING THE CLAIM.

8. Governing Law and Jurisdiction

These Terms, and any disputes arising out of or related to your use of our Services, shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located within Pennsylvania.
